The terms for using joinplank.com, the research published on it, and the limits of what Plank promises about the site.

joinplank.com is operated by IDYIA, LLC, trading as Plank. By using the site you accept these terms. If you do not accept them, do not use the site.
We may change these terms. The version at the top of this page tells you which set applies, and using the site after a change means you accept the changed terms.
These terms cover this website. They do not govern any service Plank provides.
Services are governed by a signed agreement, not by this website:
Plank's services are provided under a separate written agreement: a master services agreement, a statement of work, or an order form signed by both parties.
Where anything on this website differs from that agreement, the signed agreement applies.
Nothing on this website is an offer capable of acceptance, a quotation, or a commitment on price, scope, timing or availability, and nothing on it varies an agreement already signed.
The site and everything in it, including text, design, code, graphics, photographs, reports and datasets, is owned by Plank or licensed to Plank, and is protected by copyright and other laws.
You may read the site, and print or save pages for your own reference.
Plank publishes research on the forward-deployed engineering market, including a census of open roles and reports drawn from it.
You may quote from it and cite its figures, provided you attribute them to Plank and link to the page you took them from. You may not republish a dataset in bulk, sell it, or present the work as your own. Retrieval, indexing and citation by search engines and AI assistants are permitted, within the limits set in /robots.txt and at a request rate that does not degrade the site.
The research describes a market as at the date stated on each page, and is published for information. It is not advice, and it is not a substitute for your own diligence. Plank does not warrant that any figure is complete, current, or fit for a decision you are about to take. Decisions you take on it are yours.
"Plank" and the Plank logo are trademarks of IDYIA, LLC. You may not use them without our written permission, except to refer to Plank accurately.
Other company names, logos and product names on the site belong to their respective owners and are used to identify those companies. Their appearance does not imply that they endorse Plank or are affiliated with Plank, except where the page says so in terms.
When you use joinplank.com:
Do not use it for anything unlawful, or in a way that breaks a law that applies to you.
Do not try to gain access to the site, its servers, or any connected system, beyond the access the site offers you.
Do not probe, scan or test the security of the site, except under written authorisation from Plank.
Do not interfere with the site's operation, and do not place a load on it that degrades it for others.
Do not misrepresent who you are, or claim an affiliation with Plank that you do not have.
Do not copy the site or its design to pass it off as your own.
If you believe you have found a security vulnerability in this site, write to hello@joinplank.com before doing anything else with it.
If you send us an enquiry, an application, feedback or a suggestion, you confirm that you are entitled to send it and that sending it breaks no obligation you owe anyone else.
Treat anything you send as not confidential, unless a non-disclosure agreement is in place between us or the page you sent it through says otherwise. Do not send confidential technical information, credentials, or personal data about other people through a web form or ordinary email. If you need a confidential channel, ask us.
If you send feedback or a suggestion about this site or about Plank's services, you allow us to use it without obligation to you and without payment. This does not affect your rights in anything you send us under a signed agreement.
The site links to sites Plank does not control, and uses third party services for scheduling and for application forms. Those services are governed by their own terms and their own privacy notices, and Plank is not responsible for them. A link is not an endorsement.
We do not promise that the site will be available without interruption or free of error. We may change, suspend or withdraw any part of it at any time, and we are not obliged to keep any page, figure or dataset published.
The site and its content are provided "as is" and "as available". To the fullest extent the law allows, Plank excludes all warranties, conditions and representations, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of content.
To the fullest extent the law allows, Plank is not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, data or goodwill, arising out of or relating to your use of this site, however caused. Plank's total liability arising out of or relating to this website and these terms is limited to one hundred United States dollars.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, and liability for fraud.
This limit applies to the website only.
It does not limit and does not qualify Plank's liability under a signed services agreement. That agreement sets its own limits, and those are the ones that govern the services.
You will indemnify Plank against claims, losses, liabilities and reasonable legal costs arising from your use of the site in breach of these terms or in breach of the law.
These terms, and any dispute arising out of or relating to them or to this website, are governed by the laws of the State of California, without regard to its conflict of laws rules. The state and federal courts in San Francisco, California have exclusive jurisdiction, and you consent to that jurisdiction and venue.
If you use the site as a consumer in a country whose law gives you rights you cannot contract out of, this section does not take those away.
If any part of these terms is found unenforceable, the rest continues to apply. A delay in enforcing a term is not a waiver of it. You may not assign your rights under these terms; Plank may assign its rights to a successor of its business.
